Terms of Service

These Terms of Service ("Terms") govern your use of the GoSteady smart walker cap and the GoSteady app and website (the "Service"), provided by GoSteady LLC ("GoSteady," "we," "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
GoSteady is a general wellness and activity-monitoring product. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any disease or condition, and does not provide medical advice. GoSteady estimates walking activity from motion sensors and those estimates are approximate and may be inaccurate or delayed. GoSteady does not detect falls, emergencies, or medical events and is not an emergency-response or medical-alert system. Never rely on GoSteady for emergencies or urgent medical needs. In an emergency, call 911 (or your local emergency number). Always seek the advice of a qualified health provider for medical decisions; do not disregard professional advice because of anything provided by the Service.
1. The Service
The Service estimates a walker user's daily walking activity (such as steps, distance, and active time) and presents summaries and trends to authorized users. Features, accuracy, and availability may change over time.
2. Accounts & Eligibility
You must be at least 18 to create an account. You agree to provide accurate information, keep your credentials secure, and are responsible for activity under your account. You may invite other people (such as family members) to view a care recipient's activity only if you are authorized to share that information.
3. Consent of the Monitored Person
If you set up GoSteady to monitor another person's activity, you represent that you have that person's consent (or the legal authority to act on their behalf) to collect and view their activity data through the Service.
4. Communications & SMS
By providing your mobile number and opting in, you consent to receive one-time login codes and account/activity text messages. Message and data rates may apply; reply STOP to opt out, HELP for help. See our Privacy Policy for how we handle your mobile information.
5. The Device
Use the GoSteady cap as intended on a compatible walker. Do not open, modify, or misuse the device. Battery life and connectivity vary; the Service may be unavailable if the device is out of power, out of cellular range, or not functioning.
6. Acceptable Use
You agree not to misuse the Service, including: violating law; infringing others' rights; attempting to access accounts or data that are not yours; reverse-engineering or disrupting the Service; or using it to harass or harm others.
7. Intellectual Property
The Service, including software, devices, and content, is owned by GoSteady or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended personal purpose, subject to these Terms.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ACTIVITY ESTIMATES ARE ACCURATE OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSTEADY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM RELIANCE ON ACTIVITY DATA OR FROM ANY FAILURE OR DELAY OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.
10. Indemnification
You agree to indemnify and hold GoSteady harmless from claims arising out of your misuse of the Service or your breach of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Denver, Colorado, unless otherwise required by applicable law.
13. Changes
We may update these Terms; we will post the updated version here and revise the effective date. Continued use after changes means you accept them.
